Conditions of Use

The terms that govern your use of the Nyxarion Tundravorn platform and any related services in Canada.

These Conditions of Use ("Terms") set out the rules that apply when you visit the Nyxarion Tundravorn website, request a consultation, or maintain a client relationship with Nyxarion Tundravorn ("we", "us", "the platform"). By using the platform you agree to these Terms.

1. Scope of the platform

The Nyxarion Tundravorn platform is an independent information and strategy service for digital assets, focused on the Canadian market. It is not a securities dealer, not a custodian, and not an exchange. We do not custody your assets, do not execute orders on your behalf without your written instruction in an engagement that explicitly allows it, and do not promise specific returns.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use the platform. By using the platform you confirm that you meet these conditions. The platform is intended primarily for residents of Canada; non-residents may be served at our discretion and subject to local restrictions in their jurisdiction.

3. Account responsibilities

If you create a Nyxarion Tundravorn account, you are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for promptly notifying us of any unauthorised access. You agree not to share access to your account with third parties without our written consent.

4. Information & risk

4.1 Not personalised advice

Content on the Nyxarion Tundravorn platform — articles, videos, downloadable documents, dashboard screens, and general written commentary — is provided for information and orientation only. It does not constitute personalised investment advice, tax advice, accounting advice, or legal advice, and does not establish a fiduciary relationship by itself.

An engagement may include personalised guidance; in that case the terms of the engagement letter govern, and these Terms apply to anything not covered by it.

4.2 Risk acknowledgment

Digital assets are high-volatility instruments. They can lose substantial value rapidly, may become illiquid, and in some cases can become worthless. Past performance is not a reliable indicator of future results. Tax treatment of digital-asset transactions in Canada is complex and can change. You should consult a registered Canadian advisor and a qualified tax professional before making material decisions.

4.3 No guaranteed outcome

Nothing in the Nyxarion Tundravorn platform — written or otherwise — is a guarantee of return, capital preservation, or any specific outcome. You should only commit capital you can afford to lose.

5. Acceptable use

You agree not to: (a) use the platform for any unlawful purpose; (b) attempt to gain unauthorised access to any part of the platform or its underlying infrastructure; (c) interfere with the operation of the platform; (d) scrape, reverse-engineer, or systematically extract content without our written consent; (e) impersonate any person or misrepresent your affiliation.

6. Intellectual property

The Nyxarion Tundravorn name, logo, and all written and visual content on the platform are owned by or licensed to Nyxarion Tundravorn and are protected by Canadian and international intellectual-property law. Personal, non-commercial use is permitted. Reproduction or redistribution requires written permission.

7. Third-party services

The platform may link to or rely on third-party services (hosting, email, analytics, scheduling). We select reputable providers, but third-party services have their own terms and we are not responsible for their availability or for the consequences of using them.

8. Disclaimers

Except as required by Canadian consumer-protection law, the platform is provided "as is" and "as available", without warranties of any kind — express or implied — including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted or error-free.

9. Limitation of liability

To the maximum extent permitted by Canadian law, neither Nyxarion Tundravorn nor its representatives shall be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or investment, arising out of or relating to your use of the platform. Where liability cannot be excluded by law, our aggregate liability is limited to the greater of CAD 100 or the fees you actually paid us in the 12 months before the event giving rise to the claim.

10. Indemnity

You agree to indemnify Nyxarion Tundravorn against losses arising from your breach of these Terms, your misuse of the platform, or your violation of any applicable law.

11. Termination

You may stop using the platform at any time. We may suspend or terminate access if you breach these Terms, if continued service would be unlawful, or for legitimate business reasons with reasonable notice. Sections that are intended to survive termination (intellectual property, disclaimers, limitation of liability, governing law) continue to apply.

12. Governing law

These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable in it, without reference to conflict-of-law rules. The courts of Ontario have exclusive jurisdiction, subject to any mandatory consumer-protection rules in your province of residence.

13. Changes

We may update these Terms from time to time. Material changes will be posted on this page with an updated "last updated" date. Continued use of the platform after a change constitutes acceptance of the revised Terms.
